DESIGN PROCESS

Brockton Gems provides an initial no cost client meeting to discuss design, gemstones and cost.  Once a concept and price is agreed to, we request a 50% deposit to begin the formal design process.  Once the deposit is paid we will provide a design concepts for the customers review.  Initial design process can take 2 to 4 weeks.  Additional design revisions may incur additional time and fees.

Once the final design is approved, Brockton Gems will proceed to production. No further changes are possible once the item goes into production.  The production of the custom order will take another 2 to 4 weeks.  

PAYMENT TERMS

Total price of the custom order will be agreed upon before the formal design process is started.  We request a 50% non-refundable deposit to start the formal sourcing and design process.  The balance is due upon completion of the custom order and prior to delivery.  Any items that are not paid for in full within 6 months of completion will be forfeited by the customer and become the property of Brockton Gems.

TIMING

Estimated timelines are subject to change due to the nature of custom work. Brockton Gems agrees to keep the client informed of any material delays or issues. Time is not of the essence unless otherwise agreed in writing.

CANCELLATION POLICY

Due to the custom nature of the work, the deposit is non-refundable. If the client cancels after final design approval or during production, the client remains responsible for all costs incurred up to the date of cancellation.

OWNERSHIP OF INTELLECTUAL PROPERTY

  • The final work becomes the property of the client upon full payment.
  • The Brockton Gems retains ownership of all design concepts, sketches, and intellectual property rights associated with the design.
  • Brockton Gems may create additional items using its design or reproduce the design or images of the work for promotional purposes

WARRANTIES AND REPAIRS

Brockton Gems offers a 6 month workmanship warranty on the final custom piece. This does not cover damage due to misuse, normal wear and tear, or third-party alterations. Repairs outside of warranty may incur additional charges.

RETURNS, REFUNDS AND EXCHANGES

Custom orders are final sale and are not returnable, refundable or exchangeable.  

CLIENT SUPPLIED MATERIALS

If the client provides materials (e.g., heirloom stones or metals), Brockton Gems will handle them with care. However, the client assumes all risks related to the use of such materials. By going forward with such a custom order, client agrees and acknowledges:

Client understands that the process of designing, altering, or resetting jewellery—particularly where heirloom pieces are used—involves inherent risks, including but not limited to:

  • Damage to gemstones, metals, or settings
  • Loss of or inability to recover certain components
  • Irreversible alterations to the original form or composition of the heirloom pieces


The client hereby voluntarily assumes all risks related to the handling, alteration, and setting of their heirloom pieces and agrees to waive any and all claims against Brockton Gems, its owners, employees, contractors, and affiliates for any damage, loss, or change in condition of the heirloom pieces that may occur during or as a result of the work.

The client is strongly advised to obtain independent insurance coverage for any heirloom pieces before submitting them for service. Brockton Gems does not provide insurance coverage for client-owned items.

The client represents and warrants that they are the lawful owner of the heirloom pieces and have full authority to authorize their use and modification. The client agrees to indemnify and hold harmless Brockton Gems from any and all claims arising from a breach of this representation.
